Terms & Conditions of Borrowing
& Liability Waiver

These Terms and Conditions (T&Cs) form a legally binding agreement between you, hereafter called the “Member” and “Borrow Not Buy Ltd” T/A “DIY Depot of Tools”, from here on called “the Company”. They define your rights, responsibilities, and obligations when using the “DIY Depot of Tools” services. By tools we mean tools, items, or anything that you borrow.

These T&Cs help protect the rights and interests of a Member and the Company. They establish guidelines for proper tool usage, safety protocols, liability limitations, and the handling of personal data. These T&Cs include guidelines on maintaining tool condition, reporting damages, and addressing any concerns on safety to ensure the longevity and availability of tools and items for all Members.

These T&Cs ensure that the Company operates in compliance with relevant UK laws, regulations, and standards. Any legal action relating to these T&Cs shall be exclusively brought in the courts in England. The Company operates on the principle of sharing resources and promoting sustainability.

Acceptance of Terms

By becoming a member of the Company and using our tool library services, you acknowledge that you have read, understood, and agreed to comply with the following T&Cs.

If you do not agree with any part of these terms, please refrain from using the Companies services.

Your acceptance of these T&Cs constitutes a legally binding agreement between a Member and the Company. You agree to abide by all the terms, policies, and guidelines. The Company reserves the right to update, modify, or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised version on the website or notifying you via email. It is your responsibility to review the T&Cs periodically to stay informed about any updates. Should any part of these T&Cs become ineffective it shall not affect the remainder of this agreement or make the whole agreement void.

Your acceptance of these T&Cs applies to your current and future interactions with the Company. If you continue to use the Company services after any modifications to the Terms and Conditions, it will indicate your ongoing acceptance of the updated terms.  Failure to comply with any of the T&Cs may result in the termination or suspension of your membership and right to borrow tools or items.

By accepting these T&Cs, you confirm that you have read and understood the provisions contained within and that you agree to be bound by them. If you have any questions or concerns regarding these terms, please contact us for further assistance.

Membership

Membership is open to it’s designated “District” that encompases local towns and adjoining parishes. Members and 2nd Named User must be over 18 years of age and reside in the same household.

A 2nd Named Member of a Premium Member shall emjoy the same benefits (Discounts & Cashback opportunities) as the main Premium Member FOC.

Tool Borrowing and Responsibilities

  • The tools available for borrowing from the Company are intended for community use and should only be used for their intended purposes and in the spirit intended for the ongoing success of the project.
  • Tools may be borrowed for a maximum period of 14 days (extensions to this period can be requested).
  • Members are responsible for inspecting the tools prior to borrowing them and reporting any existing damage or defects to the library volunteers.
  • Members are responsible for the proper and safe use of the borrowed tools.
  • Tools should not be loaned, rented, or sub-let to others, or used for a professional task.
  • Members are responsible for returning the tools in the same condition as they were borrowed, except for normal wear and tear.
  • Members must clean the tools after use and return them in a usable condition.
  • Members should promptly report any damage or loss of tools to the library volunteers.

Descretionary Charges – Late Returns/Tool Cleaning and Surcharges

  • Members should return the tools/items by the agreed return date.
  • If the tools are not returned by the agreed return date, the borrower will be expected to face a late return charge of  £3 per day, following 1 day late.
  • The late return donation will go towards supporting the maintenance and acquisition of tools for the library.
  • The Company reserves the right to refuse further tool borrowing  privileges to Members with excessive late returns  late returns.
  • Members are responsible for the safekeeping of the tools or items while in their possession.
  • If a tool is lost, stolen, or damaged beyond normal wear and tear while in the Members possession, the Member will be responsible for the  cost of repair or replacement.
  • The Company suggest that the Member can take a picture of the borrowed item before leaving the DIY Depot.

Liability Waiver for the borrowing of Tools and Items

I understand that the Company allows members to borrow various tools, including but not limited to electrical tools such as hedge trimmers and drills, for personal use, free of charge. In consideration of being granted access to and use of these tools, I willingly and voluntarily agree to the following:

Assumption of Risk

I understand and acknowledge that the use of tools, particularly electrical tools, carries inherent risks, including the risk of personal injury, property damage, and even death. I hereby assume all such risks associated with the use of the tools borrowed from the Company. I accept full responsibility for my own safety and others while using these tools and items.

Release and Waiver of Liability

To the maximum extent permitted under UK law, I release and discharge the Company, its volunteers, and affiliated organisations from any and all liability, claims, demands, actions, or causes of action arising out of or in connection with my use of the borrowed tools. This includes, but is not limited to, any injuries, damages, losses, or expenses incurred as a result of the use, misuse, or condition of the tools, whether caused by the Company’s negligence or otherwise.

Indemnification

I agree to indemnify and hold harmless the Company, its volunteers, and any affiliated organisations from any and all claims, demands, actions, or causes of action, including reasonable legal fees, arising out of or in connection with my use of the borrowed tools. I understand that this indemnification applies to any claims made by third parties, including but not limited to my family members, guests, or other individuals who may be affected by my use of the tools.

Safety Precautions and Proper Use

I acknowledge that it is my responsibility to exercise caution, follow proper safety procedures, and use the tools in accordance with their intended purpose and manufacturer’s instructions if available. I agree to inspect the tools before each use and report any defects or malfunctions to the Company promptly. I understand that failure to adhere to safety guidelines or improper use of the tools may result in injury or damage for which I assume full responsibility.

Please ensure that you use the necessary safety equipment/PPE, e.g. gloves, ear protection, eye protection, etc.

You hereby understand and agree to the Company holding your contact details which will only be used for the purposes of borrowing, volunteering or communication. Your details will not be shared with any third parties.

You understand that Borrow Not Buy Ltd. do not hold any financial information.

When checking the tick-box on the Registration Form, You acknowledge that You agree to the whole document and have READ and UNDERSTOOD these Terms & Conditions of Borrowing items it’s integrated Liability Waiver, and You voluntarily and knowingly accept all the Terms and Conditions & Privacy Policy.
